Richard Q. Nye graduated from Michigan State University with a degree in economics. Rick was trained as an Army counter-intelligence agent and served in Viet Nam. After his discharge he graduated from Detroit College of Law at Michigan State University in 1974. Rick began his practice as a litigator with one of the largest firms in Arizona. Later, he combined with real estate and commercial practitioners to form Foley, Clark and Nye, P.A. That firm grew rapidly and represented financial institutions, U.S. and international investors, developers and businesses. Rick has tried numerous jury trials, bench trials, arbitrations and all forms dispute resolution in state and federal courts. He assisted in acquisition of a small title insurance company and its evolution as Fidelity National Title Insurance Company. Partner William P. Foley acquired control of Fidelity National Title and left the practice. Rick and his partner, Robert L. Shaw, became Nye Shaw, added new partners and continued to grow. Rick had extensive representation of institutions and clients leading up to and following the demise of the savings and loan industry. Rick’s practice grew to include substantial commercial and real estate transactions in addition to litigation.

Richard Q. Nye, Ltd., was established to expand his practice handling major commercial litigation and representing international clients in their U.S. ventures and activities. His clients have found his unique mix of large scale transaction experience with the extensive litigation foundation provides wise counsel.

Rick limits his practice to commercial matters. Representative matters include acquisition of properties and investments throughout the U.S., from major residential, mixed use and commercial developments, medical and office properties, apartments, utility companies, and landmark properties including the FedEx World Headquarters Building.   He has represented the nation’s largest cellular provider in its acquisition of Arizona telecommunications sites since 1996 and has represented small companies in the acquisition and sale of telecommunication licenses. Typical clients are: a major, publically regulated Arizona water and sewer utility company, a publically traded Canadian development company in U.S. transactions, a Swiss investment company in its U.S. transactions, national title companies, medium and small limited liability companies, corporations and partnerships.

He regularly litigates business disputes, real estate matters and contested property title cases. Litigation recently successfully concluded include obtaining judgment in a dispute over title to a $28 million condominium development in Scottsdale, AZ; obtaining judgment in a dispute over a multimillion dollar commission claimed due from sale of large tracts of undeveloped land, advantageous settlement of a dispute over ownership of a publicly regulated utility company.   Transactions recently closed include acquisition of commercial office properties of $6.8 million, $19.6 million; $3.5 million; $5.4 million; unimproved land of $2.8 million, two golf courses and multifamily projects. Loan transactions recently negotiated and closed include; $4.8 million life insurance lender; $11.8 million life insurance lender; $19 million life insurance lender; $6.2 million conduit loan.
